TERMS AND CONDITIONS OF USE

1. Service

Siam Property Advice Co,.Ltd T/A Siam Villa Rentals (SVR) a division of Siam Real Estate company, outline our terms and conditions of business to the Lessor below:

SVR provide free international internet advertising to find tenant; email/phone correspondence with tenant; liaise with Lessor, establish availability, secure and confirm booking; take stage payments and security deposit.

Lessor (Owner) is responsible for property being in order, tenant check-in and check-out, inventory and tenant satisfaction. All other tenant services and requests to be handled by owner.

2. Web Listing

It is the responsibility of the Owner to ensure that the details advertised on our web site are accurate and up to date. SVR will not accept any tenant complaints due to inaccurate information shown which is the responsibility of the owner to advise SVR of any changes and ensure the property is ā€œfit for purposeā€ at all times.

3. Security Deposit

A security deposit of 20,000 THB is taken prior to check-in from the Lessee (tenant) and held in our escrow account to cover any unpaid bills, or damage/loss to the property on departure. At check-out: Lessor to confirm property in order and to notify SVR with 48 hours that there are no unpaid bills or loss/breakages or damage to the property so that SVR may refund the security deposit to the Lessee. It is the responsibility of the Lessor to advise SVR of any deductions.

4 Price commission

SVR charge 15% commission + Vat for the duration (nights booked) and commission is deducted on payment from the Lessee prior to occupation.

5 Payments

The Lessee (tenant) pays 50% on making booking and 50% 30-days prior to check-in.

Reservation deposit of 25% passed to owner on reservation.

Full payment to the owner - less security deposit and Broker commission - is passed to the Lessor (Owner) within 30-days of check-in, provided full payment has been received by the tenant.

6. Cancellation policy

Confirmed bookings made and then cancelled are subject to the following:

Cancellation by tenant:

  • 50% refund of initial deposit if 60 days or more prior to check-in, or 25% of total booking if 100% paid 60 days or more prior to check-in.
  • No refund, if 60 days or less prior to check-in

Cancellation by Lessor (Owner):

If the owner's property is unavailable for the dates booked and as previously confirmed by the owner and the booking party has partially paid in advance, then the owner accepts and agrees to pay compensation to the booking party and the broker as follows:

  • Booking party to receive refund of 10% booking fee made.
  • Broker to receive full commission fee (as per SRE Terms of Business) plus VAT.

7. Lessee cancelation

In unlikely event lessee cancels SVR will not refund any commissions to the lessor to cover costs.

8. Inventory

It is the Lessor (owner's) responsibility to provide an inventory prior to occupation by the tenant and for the tenant to agree to this list on check-in. Failure to do this could result in disputes with the tenant on departure.

9. Pre-arrival property check

It is the owner's responsibility to ensure that the property is fully furnished and in tip top condition, clean, aired, air con working and that all amenities are provided such as kitchen utensils, kitchenware, bed linen, towels, and if with garden and swimming pool that they have and are regularly maintained.

10. Insurance

The property must be fully insured. Failure to properly insure the property is at the owner's risk. Broker accepts no responsibility.

11. Services included

It is important you advise SVR in advance what is included in the tenancy as regards services such as electric, water, telephone, UBC, gardener, maid, pool cleaning etc.. If anything is extra, an indication of cost is notified to the tenant in advance of occupancy, although this information should already be part of our web listing for your property. However, being a holiday rental, everything should already be included in the rental price.

12. Tenant services while in occupation

The Lessor (owner) is responsible for all matters relating to the property that may arise during occupation by the tenant. SVR, by having advertised and found the tenant, has fulfilled its duty and obligations and the tenant should contact the owner direct for any problems, complaints or services required during occupancy.

13. Disclaimer

Siam Property Advice Co.,Ltd T/A SVR are the agents only, and accept no responsibility or liability whatsoever for any accident, disputes, loss of property, damage or mishaps while a tenant is in occupation of the owner's property.

14. Terms & Conditions

In addition, SVR and Siam Real Estate website use terms and conditions apply.

15. Taxes

All charges are subject to value-added-tax (VAT) at local rate, currently 7%.
